Terms of Use

The Service

Scout Create provides scouting-report tools, team analytics (including Coach’s Corner), recruiting features on eligible plans, and related coaching software. Women’s Basketball is the current launch sport. Other sports may appear as coming soon and are not part of the paid offering until we say otherwise.

College statistics and related content in the Service are compiled from publicly available sources and our own processing. We do not guarantee completeness, accuracy, or uninterrupted availability of any team, game, or player data.

Accounts

You must provide accurate account information and keep your password confidential. You are responsible for activity under your account. One login is for one coach or staff member — do not share credentials or resell access. Notify us through the contact form if you believe your account has been compromised.

We may suspend or close an account that violates these Terms, abuses ingested data, attempts to scrape or redistribute the Service, or creates risk to other customers or our systems.

Plans, trials, and payment

Paid plans (currently Basic, Premium, and Recruit) are described on our pricing page. Prices are in U.S. dollars and may change for future billing periods. We will not change the rate of a term already paid. Subscriptions renew automatically until you cancel.

Payment, invoices, payment-method updates, and cancellation are handled by Stripe. After you subscribe, use Manage billing on your profile to open the Stripe customer portal. A free trial, when offered, does not require a card and is limited as described at signup (currently one full scouting report).

Coupon codes, when we offer them, apply only at checkout and only as stated for that code. Refunds are described in our Refunds & Billing policy.

Your content and our content

You retain rights in notes, reports, and other material you enter (“Your Content”). You grant Scout Create a limited license to host, process, and display Your Content solely to operate the Service for you. You represent that you have the right to submit Your Content.

The Service — including software, templates, layouts, documentation, compiled datasets, and Scout Create branding — is owned by Scout Create or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription for your program’s internal coaching purposes only. You may not copy, scrape, resell, or publicly redistribute our datasets or the Service.

Acceptable use

• Use the Service only for lawful coaching, recruiting, and program operations.
• Do not attempt to access another customer’s account, probe our systems, or bypass plan limits.
• Do not use automated tools to harvest data from the Service except features we provide (for example PDF export of your own reports).
• Do not upload malware or content that is unlawful or infringes others’ rights.

Disclaimers and liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOUT CREATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Coaching decisions, game plans, and recruiting choices remain yours.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOUT CREATE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFITS DAMAGES.

Indemnity

You will defend and indemnify Scout Create and its personnel against claims arising from Your Content, your misuse of the Service, or your violation of these Terms or applicable law.

Changes and termination

We may update these Terms by posting a revised version on this page with a new effective date. Continued use after the effective date constitutes acceptance. We may modify or discontinue features with reasonable notice when practicable. You may stop using the Service and cancel as described in the refunds policy.

Governing law

These Terms are governed by the laws of the State of Vermont, USA, without regard to conflict-of-law rules. Courts located in Vermont have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect the Service or our intellectual property.
